A pregnant lady (in her very late 2nd trimester) is on her way to have a scheduled abortion at a local clinic. She stops into a 7-11 to get some water, and a robber comes in and she gets shot.....the baby is killed. In addition to other charges, should the shooter be charged for the murder of the womans baby?
I say, of course....especially since the baby is that far along.

It is an interesting question - same as if the robber shot and killed someone minutes from committing suicide. The robber should be charged with murder because they seem they had the intent to kill

I say, of course....especially since the baby is that far along.
The baby probably isn't viable at that stage (living on it's own outside the womb) I get why they would charge them with murder though.

Viability? How do you define that? Modern science has made it possible so that babies in their 2nd trimester can be viable outside of the womb, if given the proper resperators etc. I don't like the viability argument because it is impossible to define. Of course the robber shouldn't be charged with murder! The mother didn't want the baby, he was just doing her a favor. Pretty simple really. You pro-abortion people can't have it both ways.

her choice was a legitimate medical procedure and his wasn't. I don't think you could charge for murder of the unborn child due to both circumstances Age of fetus and mothers decision to abort. All i was saying is I understand why they do get charged.

Agreed. I actually do think he should be charged with the fetuses murder no matter what her intentions were with the baby. I was just playing devil's advocate.
